Terms of Service

This Agreement is between you, the authorized cardholder, and Platinum One Card (“POC”). It governs the respective rights and obligations of both parties in connection with the issuance and use of the Exclusive One Card, PlatinumOneCard, or other Platinum One card product (the “Card”). If you use or authorize the use of the Card, by that act, you are accepting the terms of this Agreement and agreeing to be bound by them. The Card enables you to withdraw and transfer funds that you have prepaid/loaded on the Card at participating Merchant Points-of-Sale ("MPOS") and Retail Loading Centers ("LC"). POC will maintain accounting records of the funds that you have loaded, withdrawn and transferred using the Card. You cannot withdraw or transfer more funds than the available balance in your Card Account. If you try to do so, the transaction will be declined. The Card is the property of First
Federal Bank and POC. First Federal Bank or POC may revoke the Card at any time without cause or notice. If First Federal Bank or POC does so, you agree to surrender the Card to First Federal Bank or POC. In that event, POC will repay any remaining prepaid balance on your Card to you after deducting all applicable fees and charges.


LOST OR STOLEN CARD CONTACT INFORMATION.
Notify POC immediately if you believe that the Card has been lost, stolen, if your Personal
Identification Number ("PIN") has been compromised, or if you suspect that any unauthorized person(s) is withdrawing or transferring money from the Card. You may call POC 24 hours a day, 7 days a week at the telephone number located on the back of the Card and deactivate your card. You may notify POC by mail at Platinum One Card, 3930 E. Patrick Lane, Suite 2, Las Vegas, NV 89120.


CARD ACTIVATION AND PERSONAL IDENTIFICATION NUMBER (PIN).
Your Card must be activated by the participating merchant at the time of purchase. Upon activation, you will be able to start using your Card for retail purchases, Card to Card transfers, ATM transactions, long distance calling and more. The Card has two distinct default PINs enclosed inside the package. Your PINs will enable you to identify yourself when using the Card. These PINs are an important security feature that functions as your signature, identifying you as the proper user of the Card and authorizing any transaction that you make using the Card. You will not reveal your PINs to unauthorized users of the Card and you assume full responsibility for any and all transactions made by such unauthorized users. Do not disclose your PINs to any persons, including POC employees, employees of POC's banks, processor, MPOS or LCs. If you voluntarily give your Card or PINs to another person, you are authorizing such person to use your Card and access your funds, whether you intend to
do so or not, and you will be responsible for their use of your Card.


CARD SERVICES.
POC generally offers the following array of services to Cardholders ("Cardholder Services"): Automated Teller Machine ("ATM") Services. ATMs that bear the network logos that appear on the back of the Card for fund withdrawals and for inquires about the amount of funds available to you.

MERCHANT SERVICES.
Purchase goods and services at any retail or other establishment that displays the network logos that appear on the back of the Card.


CARD-TO-CARD TRANSFER SERVICES.
Transfer available funds among active POC cards.


LONG DISTANCE TELEPHONE SERVICES.
Make local and long distance telephone calls through a designated telecommunications service provider.


USING YOUR CARD
Loading: You cannot obtain cash from the Card until it is loaded with value and the balance is available. You can load the Card at a participating LC, by card to card transfers, or other method specified by POC. You will not pay or receive any interest on the funds that you load onto the Card or on your available balance. Please note that there may not be any LC in your location. Please visit www.platinumonecard.com for the nearest LC.


Usage: Once the Card is loaded and there is a balance, you can use the Card for the above Card Services. You must present your Card and have your Account Access Code (PIN) available to load the Card or to make a withdrawal or transfer of funds from the Card. You cannot make withdrawals or transfers in excess of the available balance on the Card. Upon any withdrawal or transfer of funds, the available balance on the Card will be reduced by the amount of such withdrawal or transfer. You agree to permit any person to whom you present the Card to verify the authenticity of the Card with POC before completing a transaction. You are responsible for all transactions initiated by use of the Card and your PIN. You may use your Card only in the manner and for the purposes authorized by this Agreement. POC may recognize a transaction even if POC has not authorized it, but that does not mean POC will authorize the same transaction again. POC may restrict access to your Card account if POC notices excessive use of your Card.


Account or other suspicious activities: In that event, POC will attempt to notify you. POC will reinstate the Card once POC has determined that the use of your Card was proper in POC's sole discretion.

Foreign Exchange: If you withdraw or transfer funds using the Card in a foreign country, the amount will be converted to the local currency at a rate determined by the ATMs financial institution. POC does not control the exchange rate at the date or place of exchange.


Cardholder Support and Service: You may check your Card balance and transaction activity and initiate other customer service requests by calling the number indicated on the back of your Card or on the Internet at www.platinumonecard.com at any time. POC's primary office business hours are Monday through Friday 8:00am-6:00pm, CST with the exception of any state or federal banking holidays.


Fees and Charges: Fees applicable to the use of the Card are set out below. Fees are subject to change.


SCHEDULE OF FEES AND CHARGES (US Dollars).
ATM Withdrawals: An ATM Withdrawal fee of $2.50 per domestic (US) and $5.00 per international withdrawal request will be deducted from the available balance on your Card Account.


ATM Surcharges: An ATM owner or operator may impose a surcharge for your use of its ATM. The amount of the surcharge will be disclosed at the ATM. Any such surcharge will be deducted from the balance of your Card Account, along with the amount of the withdrawal performed at the ATM. You must agree to the ATM surcharge in order to complete the withdrawal.


Balance Inquiries / Declines: There will be a fee of $2.00 for any balance inquiries and a $1.50 fee for declined withdrawals performed at a domestic (US) ATM and $2.00 per international ATM inquiry, with a $2.00 fee for international ATM declines. You can review your Card Account balance by calling the telephone number located on the back of your Card. From International locations, visit our website at www.platinumonecard.com on the Internet. This information is available to you 24 hours a day, 7 days a week.


Deposit / Load: There will be a $5.00 fee per $500.00 for loading your Card at a participating LC


Purchases: A fee of $1.50 will be charged for domestic (US) purchases. A $2.00 fee will be charged for all international purchases. A fee of $1.00 will be charged for domestic declined purchases or returns, and a fee of $2.00 will be charged for international declined purchases or returns.


Transfers: You can transfer funds from one Card to another using the same "Card Your Money" platform. A fee of $5.50 will be charged for all Card-to-Card Transfers.


Administrative Fees: A maintenance fee of $5.99 will be charged monthly. In the event that there is no activity on the account for three (3) consecutive months, a Service Inactivity fee of $5.50 will be charged monthly or until activity resumes.


Long Distance Telephone Fees: For Long Distance Service call 888-319-2999 and follow the prompts. Calls will be charged at a rate of $0.045 per minute for Domestic (US). See the schedule posted to the website at www.platinumonecard.com for all international calls.


Direct Deposit: Free to cardholders who have their payroll deposited directly on to their card account by their employer. Automated Voice Response Fees. There is a $0.99 fee for all calls made to the Automated Voice Response (AVR) system that result in a transaction, i.e. balance inquiry, last ten transactions, customer service, etc.


Statement Fees: Your Card Account balance and activity information is available free of charge at www.platinumonecard.com.

Card Statements: Under the Electronic Fund Transfer Act you can request periodic statements from POC. You can choose to receive the following information in paper form or electronically. If you choose a paper statement, please call the number on the back of your Card and speak to a customer
service representative. Applicable fees will apply.


LIABILITY.
Our Liability: POC will have no liability to you other than to account for all amounts loaded on the Card less withdrawals, transfers and authorized fees and charges. If POC does not complete a transfer to, or from your account, or in the correct amount according to POC's Agreement with you, even if POC is negligent in failing to do so, POC will not be liable for your losses or damages. POC will not be liable, for example, (1) if an ATM or a merchant LC refuses to honor your Card; (2) if POC fails to permit a withdrawal or transfer even though a sufficient prepaid amount remains on the Card for the transaction; (3) if the ATM where you are making a withdrawal does not have enough cash; (4) if any equipment or equipment operators and other persons involved in delivery of Card services breaks down or fails to perform resulting in defective or non delivery of such services whether as a result of POC's negligence or not; (5) if access to your account has been blocked erroneously for any reason; or (6) if there is a hold on your Card Account for any reason. POC's liability to you will be limited to paying for the prepaid amount loaded on the Card less withdrawals, transfers and authorized fees and charges.


Error Resolution: In case of errors or questions about electronic Card transactions, please notify POC as soon as possible if you think your statement or receipt is wrong. You may notify POC via telephone at the number located on the back of the Card. You may notify POC via mail at: Platinum One Card 3930 E. Patrick Lane Suite 2, Las Vegas, NV 89120. Attention: Cardholder Services. When you notify POC (1) tell POC your name and Card number (2) describe the error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information and (3) tell POC the dollar amount of the suspected error. POC may require that you send your complaint in question in writing within ten (10) business days. POC will correct any error as promptly as possible within a reasonable amount of time necessary to complete an investigation of your complaint or question. After POC concludes its investigation, POC will either credit your Card or provide you with an explanation as to why POC is not prepared to credit your Card.


Your Liability: You shall notify POC immediately if you believe that your Card has been lost or stolen or that someone has learned your PIN or Card number. Calling POC and deactivating your Card is the best way of minimizing your possible losses. You shall notify POC immediately if your Card statement shows transfers or transactions that you did not make or authorize. If you do not notify POC within thirty (30) days, and if POC can prove that POC could have not prevented the fraud incident or someone from taking or using the money if you had notified POC in time, you may not be eligible for a refund of the funds in question.


AMENDMENT.
POC may change the terms of this Agreement by giving you written notice required by law prior to the effective date of the change. If POC is unable to contact you for any reason, POC will post the changes on POC's website at www.platinumonecard.com. You will be deemed to have proper notice thirty (30) days after the amendments are posted. You are encouraged to review POC's website regularly to monitor changes in the terms of this Agreement. However, if the change is made for security purposes, POC can implement it without prior notice.


TERMINATION
POC reserves the right to terminate this Agreement or any of the services that are described herein by giving you written notice. You may at any time terminate this Agreement, or any of the services to which you subscribe by giving POC written notice. Termination will not affect any of POC'ss rights or your obligations arising under this Agreement prior to termination.


RENEWAL
The Card and this Agreement will be operable for one year after the date that the Card is activated. At the end of the initial term and any renewal term, this Agreement will be automatically renewed an additional year unless terminated. If this Agreement is terminated, you will have thirty (30) days after termination to withdraw your available balance. If you fail to do so, you may be charged administration fees for closing the account and for otherwise administering it after the thirty (30) day period has expired.


PRIVACY AND CONFIDENTIALITY.
POC may disclose information to third parties about your Card transaction history (1) where it is necessary for
completing transactions; (2) in order to verify the existence and conditions of the Card and funds loaded on the Card for a third party such as a credit bureau or merchant or an LC; (3) in order to comply with governmental agency or court orders or other legal reporting requirements; or (4) if you give POC your written permission. Information concerning your Card transaction history may be shared within POC's organization and with the Processor and the Bank. Other information you have given POC in connection with obtaining a Card, or information POC may receive from other third parties, also may be shared within POC's organization and with the Processor and the Bank.


WAIVER.
POC may waive any terms of this Agreement in a specific instance, but such a waiver shall not be construed as a continuing waiver and will not extend beyond that specific instance.


NO LIABILITY FOR THIRD PARTY PRODUCTS, SERVICES AND PREMISES.
POC is not responsible for third parties products, services and establishments, and you agree that POC will not be liable for any loss, damage or injury caused to you or any other person by any products or services purchased using the Card, even if purchased from a merchant or service provider who offers discounts or benefits to Cardholders and is recommended or advertised by POC. Further, POC is not responsible and you agree POC will not be liable for any loss, damage, injury or death that may occur to you or any other person at or near a place that a Cardholder visits to make an ATM, Debit, or LC transaction. POC can change at any time the Telephone Service Provider without any notice and POC will not be liable for any damage or problem caused by the Telephone Service Provider. All international and domestic phone calls are billed in 1 minute increments. All sales and charges are effective from January 1, 2005. Rates are subject to be changed without notice. Calls made from pay phones will be assessed up to $0.99 fee per call. The balance of the loaded telephone card has no cash value and is non-refundable. Fees and surcharges are subject to change at any time.


TELEPHONE SERVICE.
To make a long distance call, dial 888-319-2999 (this number is located on the back of your card as a reference). To access your Long Distance account, you must dial the last ten (10) digits of your card number plus your five-digit long distance pin number consecutively. As you use your minutes, the balance of your Long Distance account will be debited accordingly. Once your Long Distance balance drops below $0.50, a recharge request will occur to restore your Long Distance account balance to $3.00 within approximately 15 minutes, and your Stored Value account balance will be debited for the recharge amount. If your Stored Value account does not have enough money to recharge the Long Distance account balance back to $3.00, the Long Distance account will be recharged with whatever the available balance is on your Stored Value account. If there is a zero balance on your Stored Value account, or the recharge amount is not enough to make at least one phone call, a recharge will be attempted periodically to try and reload your Long Distance account to $3.00. Should you have any problems, please call the customer service number on the back of your card. POC reserves the right to adjust recharge amounts or rates at anytime. Rates may be viewed online at www.platinumonecard.com.


DISCOUNTS AND BENEFITS.
At POC's sole discretion, POC reserves the right to include access to merchants, discounts, rewards and other benefits as a feature of the Card.


APPLICABLE LAW.
This Agreement shall be governed by the laws of the State of Nevada and the United States Patriot Act. If any terms of this Agreement conflict with any applicable law, they will be modified to comply with such law(s).
